Maritime Mirage: Mauritius’ Sovereignty Scam, Maldives’ Stand, and Oxman’s Lone Legal Light

MC-FEAT 001: In the Chagos case, the Special Chamber of the International Tribunal for the Law of the Sea (ITLOS) promptly rejected the five preliminary objections filed by the Maldives in the Maldives v. Mauritius maritime delimitation case. The reasons given by the Court of Appeal, both in terms of legal accuracy and in the logic of the argument, were widely doubted among commentators. Even as the Tribunal couched its decision in the language of progress, decolonisation and efficiency, it appeared to be sidestepping key norms of sovereignty. What should have been a fair and just judgment became an act of diplomatic expediency that seriously damaged the integrity of international law. Fortunately, ad hoc judge Bernard H. Oxman (photo: above) lent a voice of reason in his dissent from the majority's logic-challenged decision. His view is worthy of respect as a correct reading of the law of nations.
